(hereinafter, “Sease”) provides the following information in accordance with Articles 13 and 14 of Regulation (EU) 2016/679 (or General Data Protection Regulation, hereinafter “G.D.P.R.”) and subsequent national implementing legislation (hereinafter referred to, together with the G.D.P.R., as the “Applicable Privacy Regulations”), making it available to all users who use the Sease website (hereinafter, the “Website”), accessible at www.sease.it

During the browsing of the Website, information relating to users may be collected, which constitutes personal data under the Applicable Privacy Regulations.

This privacy notice applies exclusively to the website mentioned above and does not cover any other websites that the user may access through the links available on it.

Types of Data Processed

Personal data automatically collected when visiting the Website

Browsing data. Sease automatically collects data about the device (PC, tablet, mobile phone, or other mobile device) and the connection used by the user, including for example the IP address, date and time of access, hardware and software information, device event information, unique identifiers, crash data, and the pages viewed by the user before or after using the Website.

These data are collected even if the user has not logged into the account created on the Website, or even if the user has not created any account at all.

Website usage data. Sease collects information on how the user interacts with the Website, including for example the pages or other content viewed, searches performed, third-party applications used on the Website (such as the map and other Google Maps features in the “Contacts” section), and the links to other websites and applications that the user has clicked on.

 

Personal data provided directly by the user

  1. Data required to use the account created on the Website and to make purchases on the Website
    • Data provided for account registration. When the user registers on the Website by creating an account, Sease collects the information required to create the account, namely email address, first name, last name, address, postal code, city, country, and telephone number (for individuals), as well as company name and VAT number (for businesses), and the shipping address.
    • Data related to the user’s account. Sease collects a series of information connected to how the user interacts with their account (for example, adding items to the cart or wishlist).
    • Transaction data. Sease collects information relating to transactions carried out by the user on the Website, including all data provided for account registration, as well as the payment methods used, the date and time of payment, the amounts paid, and other details relating to the transaction. This information is necessary for the proper and adequate performance of the contract between Sease and the user, and to allow the user to finalize their purchases on the Website.
    • Shipping data. Sease collects information about the shipment of products purchased by the user on the Website, such as the user’s billing address, the buyer’s address, and order numbers.

  2. Optional data
    • Data provided through information requests via email. If the user explicitly and voluntarily sends an email to the addresses indicated on the Website to request information, Sease acquires the user’s email address as well as any other personal data of the user (and/or third parties) included in the electronic communication.
    • Data provided to activate the newsletter service. If the user decides to activate Sease’s newsletter service, Sease collects the user’s email address.                                

  3. Personal data collected through cookies
    Sease uses cookies to collect data on the user’s activity on the Website and on their preferences, as well as other technical data relating to the user.

Purposes of processing:     

To ensure the functioning of the Website; to fulfill contractual obligations towards the user and provide them with the services offered by Sease through the Website; to protect the user’s vital interests; to comply with applicable laws or legal obligations; and to pursue other needs of public interest.

The user’s data are processed in order to:

  • to conclude and execute the purchase contract for the products sold by Sease on the Website;
  • to provide the services offered on the Website;
  • to manage requests sent to the email address;
  • to operate, measure, and improve the Website and the services provided by Sease through the Website;
  • to enable account management and payment processing;
  • to keep the services provided by Sease through the Website safe, protected, and fully operational;
  • to communicate information to the user regarding their account and to resolve account-related issues;
  • to resolve disputes with the user, recover fees and other sums owed by the user, or otherwise necessary to provide the services offered by Sease through the Website;
  • to prevent, detect, mitigate, and investigate fraud, security breaches, and potentially prohibited or illegal activities.

To pursue Sease’s legitimate interests, provided that such interests do not override the user’s fundamental rights and freedoms.

The user’s data are processed in order to:

  • identify and resolve issues encountered by the user while using the Website (for example, blocked or malfunctioning pages), and to provide the user with a better experience;
  • collect aggregated statistical information on the number of users visiting the Website (such as unique visitors) and on how users navigate the Website;
  • carry out opinion surveys and market research;
  • send personalized promotional and commercial communications to registered users (i.e., communications about products that are considered of interest to the user based on the analysis of purchases made and information regarding the user’s browsing activity on the Website, such as products viewed or added to the cart).

Subject to consent, carry out marketing activities

  • If the user has subscribed to the newsletter, with their consent (which may be withdrawn at any time in the manner described below), their data may be processed to send them (via email) marketing information, advertisements, details on promotions and special discounts, and updates on the services offered by Sease.

 

Methods of processing

The user’s personal data are processed using electronic or digital tools solely to achieve the purposes for which they were collected (see above) and are stored for a defined period according to the criteria set out in this privacy policy (see below).

The user’s personal data may be accessed and processed by Sease personnel, who are duly trained regarding the safeguards required by the Applicable Privacy Regulations.


Duration of processing

Personal data will be stored for a limited period of time, which varies depending on the purpose for which they are processed. Once this period has expired, the data will be permanently deleted or irreversibly anonymized.

The specific retention periods for the user’s personal data are documented in Sease’s record of processing activities (implemented pursuant to Article 30 of the G.D.P.R.).
The user’s personal data are retained (according to the criteria set out in Recital 39 and Article 5, paragraph 1, letter e) of the G.D.P.R.) for a period proportionate to the operational needs of the Website and to the provision of the services offered by Sease through the Website (without prejudice to the user’s right to exercise the rights granted by the Applicable Privacy Regulations, as specified below).
The user’s personal data may be retained (according to Recital 65 of the G.D.P.R.) for longer periods than those indicated above only when such extended retention is necessary for Sease to fulfill legal, administrative, or accounting obligations it is subject to, or to establish, exercise, or defend a legal claim, or to pursue other public interest needs (for example, in the event of verified orders from Public Authorities or Judicial Authorities requiring the retention of personal data as part of an investigation).
If the user has given consent for their data to be processed for marketing purposes, they are reminded that consent may be withdrawn at any time (see below).

 

Disclosure of data

With regard to the processing carried out by Sease, users’ data are handled by personnel who have been duly trained and authorized by Sease. Data will be disclosed externally only when strictly necessary for the purposes of processing described above. As part of the provision of services on the Website and in order to execute a sales contract, data may be processed by Sease’s suppliers, who have been selected and assessed by Sease based on their proven reliability and expertise.

Sease will therefore disclose users’ personal data solely and exclusively to the entities and for the purposes indicated below.


Execution of shipments and payments; prevention of unlawful acts, fraud, and security breaches

  • Sease will disclose users’ personal data (to the extent necessary to fulfill the relevant processing purposes) to third parties that provide services to Sease, in particular those responsible for processing payments, preventing and detecting potentially unlawful acts, fraud, and security breaches (as well as mitigating their negative effects on users), and collecting invoices.
  • More specifically, Sease will disclose users’ personal data, where necessary, to: email service providers, Internet Service Providers, companies specializing in IT and telematic services, companies providing customer support services, companies offering marketing services, companies specializing in market research and data processing, and banking operators.
  • Sease will also disclose users’ personal data (to the extent necessary to fulfill the relevant processing purposes) to third-party shipping service providers, with whom delivery addresses, contact information, and order numbers will be shared in order to facilitate the delivery of purchased items and the communications related to delivery.
  • Such disclosures of the user’s data enable the proper and adequate performance of the service provided by Sease.

 

Application of the law, legal proceedings, and legally authorized procedures


  • Sease may disclose users’ personal data to courts, public authorities, government authorities, or authorized third parties, in cases and to the extent that it is required or permitted to do so by law, or when such disclosure is reasonably necessary. Such disclosures may have the purpose of:
    1. fulfilling Sease’s legal obligations;
    2. responding to claims made against Sease;
    3. complying with verified requests relating to a criminal investigation or alleged unlawful activity, or any other activity that could expose Sease or its users to legal liability;
    4. protecting the rights, property, or personal safety of Sease, its employees, its users, or the public in general.


Legal bases for processing

 

Sease processes personal data only when one of the conditions provided for by applicable law (the “legal bases” or “lawful conditions”) is present, and specifically:

a) When it is necessary to perform a contract to which the user is a party.

This legal basis permits the processing of personal data in the following activities:

  • the conclusion and execution of a purchase contract for the products offered on the Website by Sease;
  • registration on the Website and use of services reserved for registered users;
  • provision of the services offered on the Website.

Providing personal data for these activities is optional and, depending on the case, may be required to conclude or perform a contract. The user is free to provide or not provide their data, but without the requested data it will not be possible to conclude or execute the contract or fulfill the user’s requests. This means that the user will not be able to purchase Sease products, use Sease services, register on the Website, use the Website’s services, and Sease will not be able to handle the user’s requests.

b) For the need to comply with a legal obligation imposed on us by law.

This lawful basis authorizes Sease to process data in order to comply with the legal obligations to which it is subject. In particular, when a purchase contract is concluded on the Website, the user’s data will be processed to fulfil the legal obligations Sease is required to meet under tax regulations and any other applicable laws.

The user is free to provide their data and to decide whether to enter into a contract with Sease; however, if they choose to do so, the data must necessarily be processed in order to comply with the relevant legal obligations imposed on Sease.

c) Based on the user’s consent.

We carry out the following processing activities only when the user has given explicit consent:

  • sending our newsletters via email;
  • conducting opinion surveys and market research;
  • personalizing the Website’s content and sending personalized marketing communications.

The user is free to provide personal data for these activities; it is entirely optional. If the user chooses not to provide such data, they will not be able to receive Sease newsletters regarding news and commercial promotions, personalized marketing communications, nor will Sease be able to conduct opinion surveys and market research.

d) For a legitimate interest of Sease or of a third party.

Data are processed on the basis of this lawful condition in the following cases:

  • statistical analyses and research aimed at improving the commercial offering and the services of the Website. In this case, processing is carried out on the basis of our legitimate interest in obtaining useful information to enhance the quality and effectiveness of the commercial proposals and services offered through the Website. Providing data for this processing is entirely optional.
  • prevention and suppression of fraud, counterfeiting, and abusive behavior. In this case, processing is carried out on the basis of Sease’s legitimate interest in preventing and suppressing fraudulent activities that could compromise the profitability of the Website and the safety of its users. Providing data for this processing is optional but constitutes a requirement for submitting an order and concluding a purchase contract, and without it, this will not be possible.
  • personalization of Website content for marketing purposes. In this case, processing is carried out on the basis of our legitimate interest in increasing the Website’s profitability by personalizing the user’s browsing experience. Providing data for this processing is entirely optional. Refusing to provide data, by objecting to this activity, will only result in the inability to view personalized content on the Website.
  • ensuring the proper technical functioning and security of the Website. In this case, processing is based on Sease’s legitimate interest in preventing and resolving situations that could compromise the operation of the Website and its services, as well as user security. Providing data for this processing is optional but constitutes a requirement for browsing and using the Website, and without it, this will not be possible.
  • protection of rights. In this case, processing is carried out on the basis of the legitimate interest of Sease or a third party to protect their rights. Providing data for this processing is optional but constitutes a requirement for browsing and using the Website, and without it, this will not be possible.
  • sending promotional communications relating to products or services similar to those already purchased. Under Article 6, paragraph 1, letter f) of Regulation (EU) 2016/679 (GDPR), SEASE may use the email address provided during the purchase process to send such communications, even in the absence of explicit consent. This processing is based on the controller’s legitimate interest, without prejudice to the data subject’s right to object at any time by using the appropriate link or by contacting SEASE.

 

Rights of data subjects

Under the Applicable Privacy Regulations, the user has the right—at any time, free of charge and without any particular formal requirements - to:

  • object to processing carried out for direct marketing purposes (such as the sending of newsletters via email, promotional SMS, opinion surveys, or personalized commercial/promotional communications via email);
  • obtain confirmation as to whether Sease is processing their data;
  • access their data collected by Sease, and know the origin of the data, the purposes and methods of processing, the retention period (or the criteria used to determine it), as well as information regarding third parties to whom the data have been disclosed;
  • withdraw consent at any time, where consent is the legal basis for processing. It should be noted that withdrawal of consent does not affect the lawfulness of processing carried out prior to the withdrawal;
  • update or rectify their data collected by Sease, ensuring that such data are always accurate and up-to-date;
  • exercise their right to erasure (“right to be forgotten”), meaning the right to have their data deleted from Sease’s databases and/or Sease’s backup archives. The user's data will be erased if:
    1. such data are no longer necessary for the purposes of the processing, or the user has withdrawn consent to the processing of their data, or has objected to the processing of their data (in the cases specified below), or their data have been unlawfully processed, or deletion is required by the Applicable Privacy Regulations; and also when
    2. the processing of the user’s data is not necessary for Sease for any of the reasons listed in Article 17, paragraph 3 of the GDPR (including, in particular, compliance with a legal obligation requiring such processing; the pursuit of public interest needs; or the establishment, exercise, or defense of a legal claim).
  • restrict the processing of personal data by Sease, in the cases provided for under Article 18, paragraph 1 of the GDPR (for example, where the accuracy of the data has been contested);
  • object at any time to the processing of data processed for the pursuit of public interest needs or for Sease’s legitimate interests, unless Sease demonstrates that such data are processed for compelling legitimate grounds or for the establishment, exercise, or defense of a legal claim;
  • for data processed on the basis of the user’s consent, or to fulfill contractual obligations towards the user and provide Sease’s services, receive such data in a structured, commonly used, and machine-readable format. The user may then transmit such data to third parties, without Sease being able to prevent this in any way;
  • receive timely communication regarding any rectification, erasure, or restriction of processing implemented by Sease, as well as any revocation of such measures and the reasons for such revocation (for example, in the case of restrictions on processing, the expiry of the limitation period or the disappearance of the circumstances that caused the restriction, such as verification of the accuracy of the user’s personal data).

The user may exercise these rights by submitting a written request to Sease, without any formal requirements, by sending an email to info@sease.it

Once this email has been received, Sease, through the data controller, will fulfill the user’s request without delay and, in any case, no later than one month from the date of receipt of the request. This period may be extended by two additional months, if necessary, taking into account the complexity and number of requests. In the event of an extension, within one month of receiving the request, Sease will inform the user of the extension and the reasons for it.

SEASE Srl operates in several countries through local entities that collect and process personal data in accordance with the data protection regulations applicable in each country. This Privacy Policy applies to all personal data collected by SEASE and its local affiliates, and ensures compliance with the General Data Protection Regulation (GDPR) for the European Union, the Federal Act on Data Protection (FADP) for Switzerland, Law No. 1.165 for the Principality of Monaco, as well as the data protection laws in force in the United Arab Emirates and South Korea.
